Terms of service

These terms cover your use of Posture. Personal use is free. An organisation that gives Posture to its staff needs a Posture for Work licence. We've kept the terms short and in plain English.

Who we are

Posture is made by Ben Huss, Immersi. It is provided by Sohus Ltd (company number 09369062, registered in England and Wales), 167–169 Great Portland Street, 5th Floor, London W1W 5PF. In these terms, "we" and "us" means Sohus Ltd, and "you" means the person or organisation using Posture.

These terms apply to the website at posturebreak.co.uk (also served at posturebreak.vercel.app), the web app, the Mac and Windows apps, and any other version of Posture we provide, wherever you get it from. By using Posture, you agree to these terms.

An organisation agrees to these terms when it accepts our quote, starts a pilot, or pays our invoice. The person who does that for the organisation confirms they are allowed to.

Personal use is free

You can use Posture for yourself, at home or at work, free of charge. There's no account and no subscription. This includes using it on your own initiative on a work computer, if your employer allows it.

Posture for Work licences

An organisation that deploys, installs or provides Posture to its staff needs a Posture for Work licence. This applies whether it uses the web app, the Mac and Windows apps, or managed installers such as the MSI and PKG. A licence covers:

• Use of Posture by the number of people in your organisation covered by your licence (your "seats"). A seat is a person, not a device: one person can use Posture on all their devices.
• Deploying Posture through your IT tools, including the MSI and PKG installers, and fixing settings through Group Policy or a configuration profile, as described in the deployment guide.
• Support by email for the people who manage Posture in your organisation.

Your licence key is a signed record of your organisation's name, number of seats and end date. Posture checks it on the device and shows those details in Settings; nothing is sent to us. The key doesn't switch on extra features, and Posture keeps working if a key expires, but your right to provide Posture to your staff ends with your licence.

If more people use Posture than your licence covers, tell us. We'll invoice the extra seats for the rest of your licence year, at your current price.

Licence price and payment

• Prices are as shown on the For business page or in the quote we give you. At the date of these terms: £2.50 per person per month, billed yearly; £2.00 from 251 people; £1.50 from 1,001 people; larger organisations on request; with a minimum of £1,500 a year.
• VAT is added where it applies.
• We invoice yearly in advance. Please pay within 30 days of the invoice date. We send your licence key once the invoice is paid.
• If an invoice is still unpaid 14 days after we remind you in writing, we may suspend or end the licence, and we may charge interest and costs as the law allows for late payment of business debts.

Licence term and renewal

• A licence lasts one year from the date it starts.
• It renews for another year when you pay the renewal invoice. We'll send the invoice before the licence ends. If you don't want to renew, just don't pay it and tell us.
• We may change prices for a renewal. If we do, we'll tell you at least 30 days before your licence ends.

Pilots

We offer a free 8-week pilot for up to 250 people. A pilot has no charge and no obligation to buy. When it ends, you need a licence to keep providing Posture to your staff. These terms, apart from the sections on price and payment, apply during a pilot. We may agree other pilot terms with you in writing.

Refunds

Licence fees are for a full year. We don't refund fees for part of a year if you stop using Posture or reduce your seats, except where the law requires, or where we end your licence without it being your fault (see Ending use).

Acceptable use

Please don't:

• use Posture in a way that breaks the law;
• sell, rent or sublicense Posture, or pass it off as your own;
• remove or change the copyright and licence notices in it;
• try to disrupt the website or the services Posture relies on, or get around the checks that protect its updates;
• present Posture as a way to monitor, score or discipline people. It isn't designed for that, and it doesn't report anything about anyone.

Organisations' responsibilities

• Tell your staff that you are providing Posture, and point them to the health guidance below and our privacy notice.
• You are responsible for how you deploy and configure Posture, including any settings you lock, and for testing it in your environment first.
• Don't make doing the exercises compulsory. People should always be free to skip or stop a move.

The software and updates

• We work hard to make Posture reliable, but we can't promise it will always be available, free of errors, or suited to your particular needs. This is subject to Our liability below, and doesn't affect your legal rights as a consumer.
• Some versions are previews. At the date of these terms, the Mac app and package are unsigned and not notarised by Apple, and the Windows installers aren't code-signed, so your computer may warn you when you first open them.
• The Mac and Windows apps check this website about once a day for an update to the break screen, and only use an update that matches the SHA-256 hash published with it. Organisations can turn this check off. The four optional guide figures are downloaded from this website the first time someone chooses one.
• We may change, improve or remove features, and we may stop offering a version of Posture. If we stop offering Posture for Work during a paid licence year, we'll refund the unused part of your fee.

Health

• Posture gives general wellness guidance only. It is not medical advice, and it doesn't diagnose, treat or prevent any condition.
• The health check in Settings leaves out exercises that may not suit some conditions. It can't know everything about your health, so use your own judgement.
• Move gently and within what feels comfortable. Stop if something hurts, feels wrong, or makes you dizzy or tingly.
• If you have pain, an injury or a health condition, or you're pregnant or recovering from surgery, check with a clinician before doing the exercises.
• For organisations: Posture can help you plan breaks and changes of activity for screen users, but it doesn't replace your display screen equipment (DSE) assessments, your other health and safety duties, or occupational health advice.

Intellectual property

We, or our licensors, own the rights in Posture, including its design, text, exercise guides, animations and code. These terms give you a right to use Posture as described here; they don't transfer any ownership to you.

Posture includes third-party components under their own licences, which apply to those parts:

• three.js (MIT licence), used to show the 3D guide;
• Electron (MIT licence), which the Windows app is built on;
• guide figures from Quaternius (CC0, public domain) and Microsoft Rocketbox (MIT licence).

Nothing in these terms limits your rights under those licences.

Privacy

Posture has no accounts. Your settings, break history and health check answers stay on your device, and the apps send no analytics. So when an organisation provides Posture to its staff, we don't receive or process those people's personal data through the app, and we are not the organisation's data processor. The only personal data we receive from customers is what you send us: support emails, and the contact and billing details we need to issue licences and invoices. Our website is hosted by Vercel, which processes standard request logs, and the home page uses cookie-free Vercel Web Analytics. See our privacy notice and Security and data for the details.

Our liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law doesn't allow us to limit or exclude.

If you use Posture for yourself (as a consumer):

• Nothing in these terms affects your legal rights.
• We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We aren't responsible for loss that wasn't foreseeable, or for business losses.

If you are an organisation or use Posture for business:

• Apart from what these terms say, we exclude all implied terms and warranties, as far as the law allows.
• We aren't liable for indirect or consequential loss, or for loss of profit, revenue, business, goodwill or data.
• Our total liability to you under or in connection with these terms is limited to the fees paid and payable by you in the 12 months before the event that gave rise to the claim.

Ending use

• You can stop using Posture at any time by uninstalling it or closing it. For the web app, clearing your browser's site data removes what it stored.
• An organisation's licence ends at the end of its licence year if it isn't renewed.
• Either of us can end a licence by notice if the other seriously breaks these terms and doesn't put it right within 30 days of being asked. If we end a licence because we are in serious breach, we'll refund the unused part of your fee.
• When a licence ends, the organisation should stop providing Posture to its staff, or remove it from managed devices. People can keep using Posture for themselves under the free personal use terms.
• The sections on intellectual property, liability and governing law continue to apply after use ends.

Changes to these terms

We may update these terms, for example when Posture or the law changes. We'll put the new version on this page with a new date. If a change significantly affects an organisation with a paid licence, we'll tell you by email, and the change will apply from your next renewal unless you agree otherwise.

General

• These terms, together with any quote or order you accept from us and, for organisations, our data processing statement and agreement, are the whole agreement between us about Posture. If they conflict, the quote or order wins, except that the data processing statement and agreement wins on data protection.
• If a court decides part of these terms can't be enforced, the rest still applies.
• If we don't enforce something straight away, we can still enforce it later.
• Only you and we have rights under these terms. No one else can enforce them.
• We aren't responsible for delays or failures caused by events outside our reasonable control.
• We may transfer our rights and duties under these terms to another organisation that takes over Posture. We'll tell licence holders if we do, and it won't reduce your rights.
• We'll send notices about a licence to the email address you gave us, and you can send them to the email address below.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you're a consumer living elsewhere in the UK, you can also bring a claim in the courts where you live.
